PhMuseum Online Masterclass Program - terms and conditions

This document defines the Terms and Conditions (Terms) that govern your use of the PhMuseum Online Masterclass webpages (Masterclass). These Terms apply between You (You or Student), and PHmuseum Srl (PHmuseum or We), the Italy-based corporation with a registered office at Via Paolo Fabbri 10/2a, 40138, Bologna, Italy, Company Number IT03908051208, owning and operating the phmuseum.com website, all the related websites and services and the PhMuseum trademarks.

By ticking the Terms and Conditions box, and clicking the Apply Now or Purchase button, You join Masterclass and You hereby acknowledge and agree to be bound by these Terms and by PhMuseum’s website Terms and Conditions. Please read them carefully before purchasing or applying for a Masterclass.

1. Services offered and general rules

You can participate by clicking either on the Apply Now or Purchase button available for a Masterclass currently offered at https://phmuseum.com/education and following the application or purchasing process. You must be at least 18 years old as of the date of applying for or purchasing a spot in a Masterclass.

The Masterclass program consists of online teaching blocks (Sessions) indicated on the Masterclass webpages. The Session approximate time is described on the Masterclass webpages. The Session content is indicated and is intended as a reference for the teaching content that will be presented by the Professors and Studio visit hosts.

To participate in a Masterclass, you shall apply, receive a positive written confirmation by PhMuseum, and subsequently successfully complete the payment before the Masterclass program begins.

The Sessions will be conducted by the Masterclass Head Professors, except for the Studio visits. You are responsible to check for the date and time of the Sessions, as well as to learn how to use the Software - such as Skype, Zoom, or Google Meet - where the Sessions will be held. The same goes for the Studio Visits.

A standard Fee for a seat in a Masterclass is €2200. If You apply before 19 May at 11:59 pm GMT you can take advantage of the Early Bird Fee of €1850 and be considered for the fully-funded scholarship each Masterclass offer.

2. Participants' undertakings

By ticking the Terms and Conditions box, and clicking the Apply Now or Purchase button, You join the Masterclass and You hereby acknowledge and agree to be bound by these Terms and Conditions and You can lawfully enter into contracts under applicable law and that You are at least 18 years old.

You further agree that You are responsible for learning how to use the Software to attend the Sessions, and to connect from a quiet environment. You also agree to respect our Code of Conduct and maintain a positive and constructive attitude towards the Professors and the other Masterclass Participants.

By accepting these Terms and participating in a Masterclass, You warrant that all the information submitted is true, current, and complete. You also warrant that You are the copyright owner of any copyright works uploaded to PhMuseum, e.g. photographs, texts, drawings, and PhMuseum's use of such works will be at no charge, will not infringe the rights of any third party, and You will fully indemnify PhMuseum in the event of any infringement. If the photographs contain any material or elements that You do not own and/or that are subject to the rights of third parties, and/or if any persons appear in the photograph, You are responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the publication, exhibition and use of the photograph in the manner set forth in these Terms without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.

You also agree not to use PhMuseum in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

3. Intellectual property

All the content of the Sessions is the sole property of the Professors and, as such, fully protected by the appropriate international copyright and other intellectual property rights laws. You may view, download, and print any shared content for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions. More specifically, You must not:

  • i. Record and re-publish any content and material from the Sessions, including republication on another website;
  • ii. Sell, rent, redistribute or sub-license any content or material from the Sessions;
  • iii. Show any content and material from the Sessions in public, without prior written consent from PhMuseum and the Professors;
  • iv. Reproduce, duplicate, copy or otherwise exploit content and material from the Sessions for a commercial purpose.

4. Cancellation and refund policy

Under these Terms, you agree to make an advanced payment of €750 to reserve your place in the Masterclass program. You should further pay the remaining balance before 24 September, unless differently agreed in writing with the Company Legal Representative in order to successfully complete your enrollment.

The advanced payment is non-refundable. You further acknowledge and agree that You are not entitled to a Fee refund after 15 days from the moment that you have successfully made the payment of the enrollment fee. You also acknowledge that you are not entitled to a refund for any Session that you will be missing under any circumstances or in case you decide to withdraw from the Masterclass.

In case of the cancellation of a Masterclass by PhMuseum or the Professors, We will refund you a percentage of the fee equal to the remaining hours.

PhMuseum is not responsible for reimbursement of any costs related to wiring the fee.

5. Limitation of liability

By participating, Participants agree to release, discharge, and hold harmless PhMuseum and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in a Masterclass.

PhMuseum is not responsible for any issue with or technical malfunction of any computer online systems, servers or providers, computer equipment, software, failure of any email application to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any damage to Participants’ or any other persons’ computers related to or resulting from participation, uploading, or downloading of any teaching materials related to the Online Education Program. Neither PhMuseum nor its servants, agents, nor any other party or organisation involved in the management, promotion, or administration of a Masterclass or its entry routes or donation of prizes or their agents or subsidiaries involved in a Masterclass will accept responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to applications, or applications lost or delayed whether or not arising during operation or transmission as a result of network availability, server functions (including but not limited to security functions by software used by PhMuseum or any third party), virus, malware, trojans, bugs, or other causes outside its control.

6. Dispute and claims

You acknowledge and agree that these Terms together with the PhMuseum Privacy Policy, and PhMuseum’s general Terms as well as any claim that might arise between You and PhMuseum, shall be governed and interpreted according exclusively to the law of Italy. You further acknowledge and agree that the courts of Bologna, Italy shall be the exclusive forum where You agree to resolve any claim, cause of action or dispute between You and PhMuseum arising out of or relating to these Terms.

7. Changes to these terms

PhMuseum reserves the right to modify these Terms of Service at any time. Your decision to continue to visit and make use of the website after such changes have been made constitutes your formal acceptance of the new Terms of Service.

We ask that you check and review these Terms for such changes on an occasional basis, and we will be drawing your attention to relevant updates via email. Should you not agree to any provision of these Terms or any changes we make to these Terms, we ask and advise that you do not use or continue to access the PhMuseum website.
