Welcome to the PHmuseum 2020 Mobile Photography Prize Terms.
This document defines the Terms and Conditions (Terms) that govern your use of the PHmuseum 2020 Mobile Photography Prize (2020 Mobile Photo Prize or Prize) webpages. These Terms apply between You (You or Entrant), and PHmuseum Ltd (PHmuseum or We), the United Kingdom-based corporation with a registered office at International House, 24 Holborn Viaduct, EC1A 2BN, London, United Kingdom, Company Number 09474210, owning and operating the phmuseum.com website, all the related websites and services and the Photographic Museum of Humanity trademarks.
By ticking the Terms and Conditions box, selecting a payment option in the last step of the Prize submission process and completing the entry fee payment, You participate in the PHmuseum 2020 Mobile Photography Prize and You hereby acknowledge and agree to be bound by these Terms and Conditions. Please read them carefully before applying.
1. Grant rules
The 2020 Mobile Photo Prize begins on 5 May 2020 at 12:01 am Greenwich Mean Time (GMT) and ends 11 June 2020 at 11:59 pm (GMT). Entrants can participate by clicking on the Apply Now button available at phmuseum.com/grants/2020-mobile-photography-prize and following the guided submission process. You must be at least 18 years old as of the date of entry to enter the prize.
You can submit one or more Mobile Images (Photographs, Images, Pictures) defined as a photograph taken with a Mobile Device. A Mobile Device is defined as a portable computing device such as a smartphone or tablet computer. Each Image submitted will be taken under consideration by the Prize’s judges independently and will qualify for all the prizes detailed in section 2 below. Photos shall be uploaded in Jpg, Jpeg or Png format and each individual photo cannot weigh more than 10 megabytes. Collaborative applications, intended as photos realised and submitted by two or more photographers, are accepted. To complete the submission of a Project, the Entrant shall pay an entry fee of GBP 15 for a single Photo, GBP 25 for up to 5 Photos, and GBP 30 for up to 10 Photos. Before May 21at 11:59pm GMT Entrants can take advantage of the Early Bird deal which allows for the submission of a single Photo for 10, up to 5 Photos for GBP 15, and up to 10 Photos for GBP 25.Before May 12at 11:59pm GMT Entrants can submit a single Photo for free.
Winners will be announced at phmuseum.com/grants/2020-mobile-photography-prize within 90 days of the deadline or extended deadline day. By accepting these Terms You agree and accept that the decisions of the Judges are final on all matters relating to the 2020 Mobile Photo Prize. The 2020 Mobile Photo Prize is void where prohibited.
The 2020 Mobile Photo Prize will offer the following prizes:
- a) Mobile Photos of the Year: 1st prize GBP 2,000, 2nd prize GBP 1200, 3rd prize GBP 800, plus promotion via PHmuseum;
- b) Feature in PHmuseum’s second publication on Mobile Photography: between 150 and 250 images will be selected and featured in a book, which will be published by PHmuseum in January 2021;
- c) Collective Exhibition in Italy;PHmuseum's Team will curate a collective exhibition at PHmuseum LAB in Bologna, Italy –possibly in January 2021 during ArteFiera, one of the most important art fairs in Europe, with images from the Prize. The exact number will be defined after the call ends;
- d) Collective Features on BuzzFeed News; Kate Bubacz, Senior Photo Editor at BuzzFeed, will handpick a selection of photographs from the open call to be published on BuzzFeed News;
- e) GUP Magazine prize: 3 Entrants will be granted an online portfolio feature on GUP Magazine plus a yearly subscription to the magazine’s printed edition
- f) Yogurt Magazine prize: Francesco Rombaldi, Luigi Cecconi and Yogurt editorial team will select 3 photographers from all the submissions to receive an online portfolio feature on https://yogurtmagazine.com
- g) How To Spend It prize: Rasha Kahil, Creative Director and Katie Webb, Photo Editor will feature a selection of photographs from the open call on the magazine's website and Instagram account
- h) C41 Magazine prize: C41 Editorial Team will select 5 photographers among all of the applicants who will be granted a portfolio feature on the online version of the magazine.
- i) OnlineExhibition at PHmuseum: up to 250 entrants will be featured in an online exhibition at phmuseum.com/exhibition
- j) Up to 60 finalists and up to 9Honorable Mentions, which will be granted promotion via PHmuseum;
Prizes at points (a), and (j) will be assigned by Judges Francesca Marani, Kate Bubacz, Piero Percoco and Sarker Protick
Prize at point (b), (c) and (i) will be assigned by Judges Giuseppe Oliverio and Rocco Venezia from PHmuseum;
Prize at point (d) will be assigned by Kate Bubacz, Senior Photo Editor at BuzzFeed
Prize at point (e) will be assigned by GUP Magazine Editorial Team.
Prize at point (f) will be assigned by Francesco Rombaldi, Luigi Cecconi and Yogurt Magazine Editorial Team
Prize at point (g) will be assigned by Rasha Kahil, Creative Director and Katie Webb, Photo Editor
Prize at point (h) will be assigned by C41 Editorial Team
3. Candidates undertakings
By ticking the Terms and Conditions box, clicking on a payment option’s button in the last step of the Prize submission process, and successfully completing the entry fee payment, You participate in the PHmuseum 2020 Mobile Photography Prize and You hereby acknowledge and agree to be bound by these Terms and Conditions. By doing so, You also acknowledge and agree that You will not be able to delete or edit any information to the submitted Project from the PHmuseum website from the day You submit the Project to 120 days after the 2020 Mobile Photo Prize deadline or extended deadline.
By accepting these Terms and entering the 2020 Mobile Photo Prize You warrant that the Photos submitted are taken from a Mobile Device and that all the information submitted is true, current, and complete. You also warrant that You have all the necessary consents in relation to your entry and that You are the copyright owner of any copyright works submitted, e.g. photographs, texts, drawings, and PHmuseum's use of such works will be at no charge, will not infringe the rights of any third party, and You will fully indemnify PHmuseum in the event of any infringement.
When You submit photographs to the PHmuseum website, You remain the copyright owner of the photographs You submit to the PHmuseum website and PHmuseum does not claim ownership over the photographs. To learn more about the copyrights treatment please visit our website’s Terms and Conditions.
By accepting these Terms You further acknowledge that the full names of the winners may be published by PHmuseum, and You grant PHmuseum a non-exclusive perpetual, worldwide royalty free license to use and publish your Images in whole or in part in any media form whatsoever, for the sole purpose of the Mobile Photo Prize’s and PHmuseum’s promotion, including on the 2020 Mobile Photo Prize’s results page. You also agree that PHmuseum will have the right to use and publish the Images for the sole purpose of promotion and marketing of the current and future seasons of the Prize on any media worldwide without any fee being paid.
By accepting these Terms and entering the 2020 Mobile Photo Prize You also grant PHmuseum a non-exclusive perpetual, worldwide royalty free license to use and publish one or more of your Images in the first edition of the Prize’spaper publication on mobile photography (Book, Publication) that will be released by PHmuseumin 2021, and all its successive editions, without any fee being paid.
If the Photographs contain any material or elements that are not owned by the Entrant and/or that are subject to the rights of third parties, and/or if any persons appear in the photograph, You are responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the publication, exhibition and use of the photograph in the manner set forth in these Terms without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.
4. PHmuseum undertakings
PHmuseum commits to credit the due amount to the cash prize winners within 120 days of the winners announcement, provided that the winner communicates via email to PHmuseum (i) valid and complete bank account details and (ii) a copy of a valid ID within 30 days after the winners announcement.
PHmuseum will notify each prize winner at the email address associated to the respective winners’ PHmuseum accounts within 90 days after the Prize closing date. The winner will have 30 days from the day he or she will be notified to answer PHmuseum and claim the prize. If PHmuseum is unable to notify the winner, or if the winner fails to respond within the fixed time period as specified, this may result in forfeiture of the prize and PHmuseum reserves the right to select an alternative winner in accordance with these Terms and the Prize information.
PHmuseum commits to always mention the author copyrights. As mentioned at paragraph 4 above, when You submit photographs to the PHmuseum website, You remain the copyright owner of the photographs You submit to the PHmuseum website and PHmuseum does not claim ownership over the photographs. By ticking the Terms and Conditions box, clicking on a payment button in the last step of the Prize submission process, and successfully completing the entry fee payment, You submit Your Images to the PHmuseum 2020 Mobile Photography Prize and you make the following representations and warranties:
- a) You can lawfully enter into contracts under applicable law and You are at least 18 years old;
- b) You have taken the picture with a Mobile Device, defined as a portable computing device such as a smartphone or tablet computer;
- c) You have obtained and have copies of model releases from all subjects depicted in the photograph(s) You submit to the PHmuseum 2020 Mobile Photography Prize, and such persons voluntarily consented to publication and/or dissemination of their likeness for all legal purposes.
Neither PHmuseum nor their associates, affiliates or partners assume any responsibility for photos submitted in violation of these Terms. Images that demonstrate violations on copyright and/or Prize policies will be removed & disqualified by PHmuseum after due investigations.
6. Limitation of liability
By participating, Entrants agree to release, discharge, and hold harmless PHmuseum and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in the PHmuseum 2020 Mobile Photography Prize-related activities.
PHmuseum assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communication lines failure; theft or destruction of or unauthorised access to Prize entries or entry forms; or alteration of entries or entry forms.
PHmuseum is not responsible for any issue with or technical malfunction of any online computer systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any damage to Entrants’ or any other persons’ computers related to or resulting from participation, uploading, or downloading of any materials related to this Prize.
Neither PHmuseum nor its servants, agents, nor any other party or organisation involved in the management, promotion, or administration of the Prize or its entry routes or donation of prizes or their agents or subsidiaries involved in the Prize will accept responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of network availability, server functions (including but not limited to security functions by software used by PHmuseum or any third party), virus, malware, trojans, bugs, or other causes outside its control.
7. Dispute and claims
8. Right to cancel or suspend the prize
If for any reason the Prize is not capable of running as planned for bugs, worms, trojan horses, denial of service attacks, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of PHmuseum that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Prize, PHmuseum reserve the right, at their sole discretion, to cancel, terminate, modify, or suspend the Prize.
PHmuseum cannot promise that the services relating to the Prize will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. These services may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons reasonably beyond the control of PHmuseum. PHmuseum will not be liable in the event that all or any part of the service relating to the Prize is discontinued, modified or changed in any way.
