Welcome to the PHmuseum Online Education Program.
This document defines the Terms and Conditions (Terms) that govern your use of the PHmuseum Online Education Program webpages (PHmuseum Education or Education). These Terms apply between You (You or Student), and PHmuseum Ltd (PHmuseum or We or Us), the United Kingdom based corporation with registered office at International House, 24 Holborn Viaduct, EC1A 2BN, London, United Kingdom, Company Number 09474210, owning and operating the phmuseum.com website, all the related websites and services and the Photographic Museum of Humanity trademarks.
By ticking the Terms and Conditions box, and clicking the Purchase or Apply button, You join the PHmuseum Online Education Program and You hereby acknowledge and agree to be bound by these Terms and by PHmuseum’s website Terms and Conditions. Please read them carefully before purchasing or applying for a Class.
1. Services offered and general rules
You can participate by clicking either on the Purchase button or on the Apply button available for the set of one-to-one online learning options (Class or Classes) currently offered at https://phmuseum.com/education and following the purchasing or application process. You must be at least 18 years old as of the date of purchasing or applying for a Class, and You can book as many Classes as you want, according to availability.
Currently PHmuseum offers three options in terms of Classes:
i. Portfolio Review, which is a single one-to-one online Class of the duration of 1 hour, held online via a telecommunications application software (Software), such as Skype or Google Hangouts, mutually agreed upon by the Student and the Mentor;
ii. Consultancy, which is a set of four one-to-one online Classes of the duration of 1 hour each, held online via a Software mutually agreed upon by the Student and the Mentor;
iii. Mentorship, which is a set of twelve one-to-one online Classes of the duration of 1 hour each, held on a Software mutually agreed upon by the Student and the Mentor.
You can book the Portfolio Review, and the Consultancy by selecting an option and successfully completing the payment. To book a Mentorship, You shall apply, receive a positive written confirmation by PHmuseum, and subsequently successfully complete the payment.
The Classes are conducted by recognised industry professionals (Mentors), and You have the option to select the Mentor You are willing to study with. You are responsible, together with the Mentor, to agree the date and time of the class, as well as to define at least 24 hours before the Class on which Software - such as Skype or Google Hangouts - the Class will be held.
The cost of one hour of Class (Fee) is GBP 85 plus VAT.
2. Students undertakings
By ticking the Terms and Conditions box, and clicking the Purchase or Apply button, You join the PHmuseum Online Education Program and You hereby acknowledge and agree to be bound by these Terms and Conditions and You can lawfully enter into contracts under applicable law and that You are at least 18 years old.
You further agree that You are responsible for agreeing with the Mentor which Software to use for the Classes, as well as to connect in time, from a quiet location, with a good and reliable internet connection. You also agree to respect our Code of Conduct and maintain a positive and constructive attitude towards the Mentor.
By accepting these Terms and participating in the PHmuseum Online Education Program, You warrant that all the information submitted is true, current, and complete. You also warrant that You are the copyright owner of any copyright works uploaded to PHmuseum, e.g. photographs, texts, drawings, and PHmuseum's use of such works will be at no charge, will not infringe the rights of any third party, and You will fully indemnify PHmuseum in the event of any infringement.
If the photographs contain any material or elements that You do not own and/or that are subject to the rights of third parties, and/or if any persons appear in the photograph, You are responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the publication, exhibition and use of the photograph in the manner set forth in these Terms without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.
You also agree not to use PHmuseum in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
3. Intellectual property
All the content of the Classes is sole property of the Mentor and, as such, fully protected by the appropriate international copyright and other intellectual property rights laws. You may view, download, and print any shared content for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions. More specifically, You must not:
i. Record and re-publish any content and material from the Classes, including republication on another website;
ii. Sell, rent, redistribute or sub-license any content or material from the Classes;
iii. Show any content and material from the Classes in public, without prior written consent from PHmuseum and the Mentor;
iv. Reproduce, duplicate, copy or otherwise exploit content and material from the Classes for a commercial purpose.
4. Cancellation and refund policy
You can cancel a Class by informing both the Mentor and PHmuseum in writing via email. For PHmuseum, you shall write to email@example.com. For the Mentor, you should write to the email address included in the booking confirmation email you receive from Us at the moment of successfully completing the Class payment. Any other cancellation method will not be deemed valid and will not entitle you to ask for a refund.
Under these Terms you acknowledge and agree that:
i. You can cancel a Class within 24 hours of receiving the booking confirmation email from Us, and get a full refund from PHmuseum, minus the transactional costs;
ii. if You cancel a Class at least 10 days before the date agreed with the Mentor, PHmuseum will reimburse You 50% of the Fee, minus the transactional costs;
iii. If You cancel the Class 9 or less days before the date agreed with the Mentor, PHmuseum will not refund You the Fee paid.
You further acknowledge and agree that You are not entitled to a Fee refund after having started the first Class of a Consultancy or of a Mentorship.
In case of a Class cancellation by the Mentor, We will refund You 100% of the Fee, unless both You and the Mentor agree on a new date for the Class.
PHmuseum is not responsible for reimbursement of any costs related to wiring the fee.
5. Limitation of liability
By participating, Students agree to release, discharge, and hold harmless PHmuseum and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in the PHmuseum Online Education Program.
PHmuseum is not responsible for any issue with or technical malfunction of any computer online systems, servers or providers, computer equipment, software, failure of any email application to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any damage to Students’ or any other persons’ computers related to or resulting from participation, uploading, or downloading of any materials related to the Online Education Program.
Neither PHmuseum nor its servants, agents, nor any other party or organisation involved in the management, promotion, or administration of the Online Education Program or its entry routes or donation of prizes or their agents or subsidiaries involved in the Online Education Program will accept responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to applications, or applications lost or delayed whether or not arising during operation or transmission as a result of network availability, server functions (including but not limited to security functions by software used by PHmuseum or any third party), virus, malware, trojans, bugs, or other causes outside its control.

7. Changes to these terms
PHmuseum reserves the right to modify these Terms of Service at any time. Your decision to continue to visit and make use of the website after such changes have been made constitutes your formal acceptance of the new Terms of Service.
We ask that you check and review these Terms for such changes on an occasional basis, and we will be drawing your attention to relevant updates via email. Should you not agree to any provision of these Terms or any changes we make to these Terms, we ask and advise that you do not use or continue to access the PHmuseum website.
